#p##e#Kone says German customers claim EUR71m in damages
Finnish lifting equipment maker Kone Corp said today certain companies and public entities claimed a total of EUR71m in damages from its German subsidiary Kone GmbH, and other elevator and escalator companies operating in Germany.
Kone said it will consider the claims and the related evidence.
The claims resulted from a decision by the European Commission in 2007 on anticompetitive practices in Belgium, Luxembourg, Germany and the Netherlands before early 2004. The Commission imposed fines totaling EUR992m on the accused companies which also included Danish Otis, Swiss Schindler and German ThyssenKrupp. Back then Kone filed an appeal with the General Court of the European Union (EU) as it considers the claims groundless.
The decision named a total 17 subsidiaries of the above groups, together with Mitsubishi Elevator Europe BV, which participated in the Dutch cartel with the aim to freeze market shares and fix prices in the sector. Some of Kone's subsidiaries were absolved from fines in respect of the cartels in Belgium and Luxembourg, as they were first to provide information about them.
